Thus the stage was set for a great constitutional struggle between a President determined not to give up executive documents and materials and a committee and a federal prosecutor who are determined to get them. The ultimate arbitration, it was believed, would have to be made by the Supreme Court. Even if the court were to rule against the President, it has no independent power to compel him to act. He is, however, subject to the impeachment powers of Congress.
That’s from July 1973, when Richard Nixon refused to turn over the Nixon tapes and set off a Constitutional Crisis that the Supreme Court ultimately had to settle. I fear that that may be where we are headed again, although note that one line: “[The Supreme Court] has no independent power to compel him to act.” Would the Supreme Court rule against Trump (even with Kavanaugh, yes, I think it would)? Would Trump comply with a Supreme Court order?
That’s the question, isn’t it?
Trump and the White House are terrified of what Congress will find out should the President comply with document requests. They are hiding incriminating information. That is the only conclusion that can be drawn from this. Giuliani is refusing to testify in front of the House unless Adam Schiff is removed, because Giuliani is that scared of Adam Schiff. The White House is absolutely terrified of the Democrats right now, and Trump is digging his own grave.
In refusing to cooperate with what Mr. Trump on Tuesday called a “kangaroo court,” the president risked ensuring the very outcome he would rather avoid. House Democrats made clear that his failure to comply with their demands for information could form the basis for its own article of impeachment.
Ignoring checks and balances is not going to sit well with the majority of Americans. The argument that the White House won’t participate in the impeachment because it’s just not fair is not going to work. You can only bully your way so far in this world, and motherf**ker, the Constitution of the goddamn United States is the line.
“The White House should be warned that continued efforts to hide the truth of the President’s abuse of power from the American people will be regarded as further evidence of obstruction,” Nancy Pelosi said yesterday. “Mr. President, you are not above the law. You will be held accountable.”
You’re goddamn right, he will be.
Meanwhile, this is actually happening. Trump is just gonna stand aside and let Turkey wipe out the Kurds.
