Tracy Morgan Sues Wal-Mart Over Crash

Last month Tracy Morgan and several others were involved in a crash where their limo was rear-ended by a tractor trailer owned by Wal-Mart. Comedian James McNair was killed in the crash and Morgan was seriously injured.

Now, Morgan and others involved in the crash are suing Wal-Mart for negligence. While this might seem initially exciting, the case as written up seems pretty weak. The driver was driving 20mph over the speed limit and was “almost” at his drive-time limit. The allegations are that Wal-Mart was aware of the fact that the driver of the truck had been awake for 24 hours prior to the accident. It won’t be an easy case to prove, and I’ll be surprised if it actually gets to court.

Wal-Mart released a statement of condolences for the victims of the crash and promising to cooperate with the ongoing investigation.

The driver of the truck, Kevin Roper, has pleaded not guilty to vehicular homicide, assault by auto, and other charges.
