Chelsea Handler, in an effort to make a statement about double standards, posted a topless photo of herself on Instagram parodying a similar topless photo of Vladimir Putin on a horse, which is what Putin uses on his Tinder Russia dating profile with the caption, “Taking this down is sexist. I have every right to prove I have a better body than Putin.”

Per Instagram’s policies, however, the photo was quickly removed. “If a man posts a photo of his nipples, it’s ok, but not a woman? Are we in 1825?” she responded to the takedown. Of course, Handler being Handler, she reposted the image with the following caption, “If Instagram takes this down again, you’re saying Vladimir Putin has more 1st amendment rights than me. Talk to your bosses.”

Instagram pulled it down again.

While the sentiment may be nice, and while gravity has been kind to Handler, this is not a First Amendment issue. Now, if a government website had posted Putin shirtless and refused to post hers, maybe Handler has a First Amendment claim, but Instagram — as a private organization — can do whatever the hell it wants, just as Handler can clearly do whatever the hell she wants.
