**Additional Update: Friend of the site and former critic Maryscott O’Connor has been nice enough to report on this over at the Daily Kos. A few of the commenters there doubt the veracity of our story, which may be justified, but we are merely passing on the information provided to us by our hosting company. We will continue to investigate this (admittedly bizarre) chain of events and keep you posted as best we can. However, we will note that the hosting company did pass along the name of the person at DHS responsible for the seizure, and we are doing our best to contact him as well. There were, apparently, hundreds of websites shut down because of the seizure, including a site called Alabama for Democracy — a story that can be read about here.

*Update: This isn’t a joke, unfortunately. And our server didn’t crash because of the link from USA Today (though, we’re seriously bummed we didn’t get to enjoy that traffic before DHS shut us down). We do appreciate all your comments, however. They’ve actually helped keep our spirits up today. And, the good news is, we will have this weekend’s reviews up (Poseidon, Just My Luck, and Art School Confidential). They may be late but, barring self-inflicted knife wounds following another Lindsay Lohan feature, we’ll get the damn things up somehow. Thanks again for hanging out.

Also, the TV Whore will be adding a “Veronica Mars” wrap-up momentarily.

As you can see, Pajiba is a mess. We were as surprised as anyone when the site went down yesterday, but based on the limited information we have, it looks like the Department of Homeland Security has seized the disk drive on which our site was hosted, and apparently they’ve also taken the backup files. So for the time being, Pajiba has no data, and we don’t think the DHS has any intention of returning the hard drive to our hosting company anytime soon. I suppose we shared server space with some punk who threatened the President or something, and now anyone on that server has to suffer the consequences. Frankly, the entire debacle is pretty heart-wrenching for us and, thus far, completely out of our control. We have no idea when, or if, the disk drives will be returned.

In the meantime, we’ve decided to copy all of our old reviews from their Google caches (thank God for Google), and do our best to rebuild the entire site from scratch, bottom up (which, for me, means relearning a lot of things on Movable Type). So, for the next few days, the place is gonna look like Oprah’s couch after Tom Cruise has had his way with it. We’ll do our best to get the most recent reviews up in as timely a manner as possible, and then we will start adding the archives. I’m not sure what that will mean for this weekend’s reviews yet, unfortunately, but I’m not resting until I get this place back into a respectable place to visit.

Anyway, thanks for your patience … thanks for dropping by … and we do hope you’ll return after we get our shit together. In the meantime, I suppose we can all thank either the Bush Administration or the dumbass terrorists threatening our government, depending on your politics.

That's pretty lame that you guys got taken down. I have to think that your data was just in the wrong place at the wrong time, otherwise you would probably have a lot more up-close and personal knowledge of what's going on. A friend of mine ran afoul of the FBI once and the first he knew of it was the knock on his door at 4:30 AM.
As an enormous fan of individual freedom, I'm offended by unilateral action that affects the innocent more than I am by almost anything else. Sometimes in grade school I would get in trouble because the teacher couldn't sort out who was being good from who was being bad, and I would get so livid I could barely think straight.

So anyway I hope your data gets back to you, but I have to say that my friend's experience does not bode well.

It shall be unlawful for a government officer or employee, in connection with the investigation or prosecution of a criminal offense, to search for or seize any work product materials possessed by a person reasonably believed to have a purpose to disseminate to the public a newspaper, book, broadcast, or other similar form of public communication, in or affecting interstate or foreign commerce.

(The exception in this act for child pornography cases is close enough to litigate but Congress did not envision shared hosting websites when they crafted this exception. I think there is a strong arguement that the exception does not apply when the majority of the people using the printing press in question have nothing to do with the crime being investigated. The government CAN be more granular in their seizure and respect for this rule requires it.)

To the moron who pointed out they were running DHS ads -- that's Google AdSense. It reads your text and puts up ads that relate to it through an algorithim. Pajiba didn't choose those ads.

Like, say, if they put up an article about you, they'd have lots of ads for people with learning disabilities.

From what I can understand in this post and its related links, DHS seized the hard drives of the domain host that also happens to host Pajiba. However, there is no indication that DHS targeted Pajiba *specifically*, yet this is the conclusion that many in this thread have come to.

The guy at the Howard Empowered blog writes that he was notified by his domain host of the disk seizure, and that "[a] similar letter was sent to all customers who have accounts on the same server." Pajiba, did you receive this "similar letter"? From what has been written here, it doesn't sound like it.

That letter posted at the blog is interesting too:

"Dear 2mHost customer,Around 1:00 pm Eastern time, Wednesday May 10, 2006 server alexandria36 which host your account for domain name alademocracy.org was unplugged by The US Department of Homeland Security agents to seize server hard drives (the main and backupd drive) beacuse of possible illegal contents (we believe its child porn contents), They removed the drives to analyse its contents and logs.
We believe that we will not get the drives back in timely manner. We sincerely apologize for the file lose and understand the seriousness of it, as well as the trouble it has created for you our valued customer."

This letter appears to be written by a non-native English speaker; the grammar and syntax reminds me of phishing and other scam e-mails that usually wind up originating from Eastern Europe or Russia and sent with no good purpose in mind.

Which is not to say that the hosting company isn't run by (or at least employing) Eastern Europeans or Russians. And, presumably, if DHS did physically seize the hard drives, then the company, or at least the server, is located in the US because DHS's jurisdiction is presumably domestic--although in the light of the CIA's "extraordinary rendition," it might not be safe to assume that. Interestingly, the name of the server is "Alexandria36." It might be named after the city where the server is located, which could be Alexandria, Virginia, which is near Washington, D.C., and right in the heart of "national security" country.

On the other hand, in the absence of further information, I wouldn't discount the possibility that the hosting company could be in some kind of trouble or is trying to pull something and is using this DHS story as an excuse, or that hackers or other saboteurs are putting out this cover story to mask their activity. With news of the NSA scandal one of the week's top stories and thus on the public's mind, the DHS story would be a plausible cover. After all, in a child-porn case, wouldn't the FBI be investigating it--and not DHS?

Publisher's Note: DDT - You make many interesting points. To address a couple: 1) We feel some slight skepticism toward the hosting company's excuse as well, but we're willing to give them the benefit of the doubt. They have not caused problems for us before, and given the number of sites affected, if they were lying, presumably they would be called on it. 2) From what we understand, the disk drives were seized in the D.C. office. In fact, I do believe they are owned by some sort of parent company (Voxel DOT NET) to our hosting company, which probably does exist in another country, given the syntax/grammar of the emails. I will also note that the name given as the person responsible for seizure does check out as a employee of DHS (a higher-up, in fact). I am reluctant to give it out, however, for fear that DHS may retaliate in some small way by, for instance, taking their sweet-ass time returning the drives, which could cause a much larger hardship on other sites that weren't as thoroughly crawled by Google as Pajiba. 3) You are entirely correct that Pajiba was not the site targetted in this instance by DHS, and we do not want to give that impression. We are merely collateral damage to some kiddie-porn fiend that DHS decided to go after. 4) As for jurisdiction, if the hosting company is in another country, Homeland Security would have standing because it would not technically be a domestic matter.

We are trying to contact DHS, though so far without any success. The joys of bureaucracy!

Finally, we love hearing theories on the matter, and if y'all know of other sites affected besides Quizlaw and the Alabama Democrats, we'd love for you to pass on that information.

I have been coming to this site for over a year, and I can not imagine my life without it. The loss of comments on previous reviews really suck.

I loved reading all the MI:III comments, I was sitting at my desk laughing every few minutes. My favorite was the one about how Tom Cruise is not harmless crazy or humorous crazy, but drink-clorox-and-snack-on-you-eyeballs crazy. I have used that phrase more than a few times in the last few days.

I hope that some of the wonderful posts will be posted again. The comments can be the best part of the review.

I wish well to the Pajiba staff in getting the site back up to its former glory. I would like to echo what has already been stated that if there is anything we as your grateful readers can do (or write), please let us know. I would gladly donate money and or coffee to help bring the site up.

This is quite unforunate.

Semi-ironically, I was going to look up the review for Sentinel last night because my boyfriend was dragging me to see it. In retrospect, without your review, I had nothing in my sights to say, "HEY! Don't do this, Jon! Pajiba says no!" Because... surely Pajiba would've said no, right? Right? Give me some hope in this dark hour.

God, I hate George Bush. And settle down, NSA, that isn't a threat on his life, such as it is. I just can't stand the man, his policies, his decisions, his cabinet, his accent, his grammar, his born again identity, his latent McCarthy tendencies or anything else about him. Deal with it: most people in this country now feel the same way. You can't arrest someone, or hijack a bunch of files, for their opinions. I think Colbert must've been right about talking into the centerpieces...I feel like I could probably whisper this into the ether and I would be arrested within 10 minutes. Sheesh.

Occam's razor: take the simplest explanation. That would be that Mohamed made a boo-boo and invented a scary story.

I'll bet you DHS has nothing to do with this, but go ahead and confirm that it doesn't. (See, you'll never believe what DHS tells you, which is why that was chosen as the excuse!)

You're building your house on a conartist's facade. I suggest getting *all* your data together and in your own hands, and migrating to a new host, one where you can have legal recourse against them if they screw you like this. You get what you pay for.

See, I appreciate that Maryscott was willing to take the bullet for me on occassion, but we have the classic parenting impasse. Age, gender, and temperament of child/ren all affect the total enjoyment of the entire family at a movie. I'm just happy that I didn't have to shell out money for Ice Age 2. And that's why Pajiba is a daily stop at our house.

I can't help but notice the irony that a group of people who would rightfully accuse others of ignorant knee-jerk reactionism are still congratulating themselves on being so subversive that George Bush personally ordered their thoughts removed from the internet when halfway through the page Dustin had already given you the reasonable explanation: the Pajiba data was on the wrong drive at the wrong time and was not the target.

There are lots of intelligent and reasonable people on here who I disagree with, and believe me when I say that this is not directed at you. Maybe my language is too strong, but to me the people reacting this way are the kind of people who divide our country from both sides. The ignorant elite and the ignorant hicks, each only interested in sounding cool in front of their friends, and in the process making their side less palatable and driving the intelligent people who are really interested in the health of this country further apart.
Or maybe it's just people yakking on an internet thread.
And just to make it clear, I love you guys and I love the intelligent commenters who make me think.

Remember, this is the reason floated for why the disks were seized, or at least this is the speculation of the hosting service that was passed onto its clients. (There's a pun in there; get it?) The hosting service 2mHost claimed that DHS seized the disks because it suspected child pornography resided on them.

However, the web version of "telephone" has garbled the message to the point that posters are decrying DHS for shutting down Pajiba. Pajiba responded by saying that it was really a victim of collateral damage as its data also resided on those disks and was probably not the target of the raid. (Another pun depending on the server architecture.) However, I might mention that Pajiba didn't clarify this until I brought up the point in a previous post.

Now, is the child-porn story a cover, either by DHS or by 2mHost? It's possible, although if true from DHS's end, I chuckle again at the irony of DHS investigating child porn when one of its employees was arrested for the same a few short weeks ago. (On the other hand, who better?)

Oh, and anon tipster, you'd better do a little more research on "Occam's Razor." The common oversimplification is that "the simplest explanation" is the preferred explanation. Occam's Razor only proposes simplicity as a deciding factor among competing theories. But those theories need some facts to go with them (otherwise, they're only hypotheses), and there are not many in this case so far (at least that we are aware of). Your "explanation" rests on two assumptions: One, that Our Man in Alexandria, Mohamed, made a boo-boo and, two, he's covering it up. Where is the evidence?
